Major General Pension Dispute: Several Retired Major General of the Indian Army and the Lieutenant General are preparing to knock the court’s door with a pension dispute that has stirred in the Defence Corridor. The case is not of any promotion, posting or service records, but the case is connected to the pension, in which the pension of a Major General and Salary Junior is equal to or less of the Brigadier.
This dispute is due to the Salary Structure and Military Service Pay i.e. MSP made after the Seventh Pay Commission. The officials associated with the matter say that the government has taken away this discrepancy for certain authorities, but the rest of the officers with similar conditions were not benefited.
Major General Pension Dispute: What is Complete Dispute?
The case is linked to the senior officers of the Indian Army, Naval and Air Force who reached the rank of Major General, Rear Admiral, Air Vice Marshal and above.
In the Army Brigadier Up to the rank the officers get the Military Service pay in addition to Basic Pay. MSP was implemented taking into account the special conditions of military service, difficult deployment and service restrictions.
But as soon as an officer becomes Major General, he stops getting MSP. The problem begins.
The total salary of a Brigadier under the Seventh Pay Commission reaches about Rs 2,33,100 after adding MSP. On the other hand, the maximum salary prescribed for Major General was Rs 2,18,200, which did not include MSP separately. In many cases, the officer who has promoted access to lower salary and lower pension status from his junior brigadier.
Questions of Economic Loss after Promotion
Retired authorities say that promotion in any government or military system means greater responsibility and better economic benefits. But in this case the situation has appeared reversed.
A Major General has to handle critical appointments at Chief of Staff and Army Headquarters at Division Command, Core Headquarters. Despite this, his pension may be equal to or less of the Brigadier who has been junior.
Retired Major General Ranjan Chand said that the Ministry of Defence gave relief while accepting discrepancy, but only those officers who had petitioned in court.

AFT had ruled out
Armed Forces Tribunal on 14 March 2023 i.e. AFT The principal bench of the Major General and the equivalent rank had decided on the petitions of the officers.
The Tribunal directed the Central Government to increase the salary and pension of petitioners to the level of their immediate junior brigadier. As well as other financial benefits.
The decision was also applicable to the officers of the Navy and Air Force in addition to the Army.

Delhi High Court Cases
The Government challenged the Order of AFT in Delhi High Court in a matter of Air Vice Marshal Lakshmi Narayan Sharma.

Controversy also in New Review of ORP
Meanwhile, the New Review of One Rank One Pension i.e. ORP was implemented from Brigadier to Vice Chief of Army Staff.
