Indian Air Force: Jammu and Kashmir and Ladakh High Court ordered to continue investigation against the Air Force Officer in Sexual Harassment Case

Indian Air Force: J&K and Ladakh High Court has directed the Special Investigation Team (SIT) to continue the ongoing investigation against the wing commander of the Air Force, canceling two orders issued by the Chief Judicial Magistrate (CJM) Badgam. A female flying officer on the accused wing commander has accused sexual harassment and rape.

What is the case?

The case is of 31st December 2023, when the female Flying Officer accused that the Wing Commander had sexually harassed him during the New Year Party held at the Officers’ Message in Srinagar. The FIR was recorded under Section 376(2) of the Indian Penal Code in Badgam Police Station on 8th September 2024 (which comes the case of rape by misusing the post and authority).

What did the court say?

The CJM Badgam issued two orders on 10 and 16 October 2024 respectively, with an attempt to decide that the accused will be sued by the Court Marshal or in a criminal court.

High Court has cancelled these orders and directed SIT to continue his investigation. The court clarified that it is necessary to ensure fair investigation in such severe cases.

Intimation of the accused

On September 13, 2024, the High Court had given the interim bail to the accused Wing Commander. The court had given this bail in his air to take into account the situation and the potential impact on the career. However, as well as strict conditions were implemented. These included regular attendance and travel restrictions before the probe officer.

The next hearing on the collateral petition of Sehrawat will be on 10 December 2024. In this case, the demand for justice for both the female officer and the accused as well as the role of the air force and the police are being investigated closely.

This case highlights sensitive issues such as sexual harassment and rights abuse in Indian armed forces. The event is forced to think that the forces also have challenges to protect women.

Experts believe that in such cases the armed forces should work with transparency and sensitivity. Also, female authorities need to create comprehensive policy to provide security and support.
