HC judgement paramilitary: Big decision of Punjab-Haryana High Court on inclusion of paramilitary personnel in the former soldier category

HC judgement paramilitary: Punjab and Haryana High Court have clarified in an important order that the decision to include retired personnel from Paramilitary Forces such as CRPF, BSF and CISF in the category of X-Serviceman (ESM) is not the subject of court but the policy of the State Government. The court said that it depends entirely on the state government whether it makes a decision in this case.

"This court cannot decide whether or not to include X-Serviceman’s definition to the retired officers of the Paramilitary Forces," Hikert said in his order given on August 18. This is a policy case and the state has to decide it. ""

This order was passed by Justice Jagmohan Bansal in dealing with the petition that was filed by Fazila resident Butter Singh of Punjab. Butter Singh was applied for the post of Constable (Driver) in the Punjab police after retire from CRPF. But they did not find the appointment under the X-Serviceman quota. On this, he sought to direct the Government of Punjab by petitioning the court that he was considered in the ESM category and appointed in the police.

The petitioner had said that the Supreme Court had declared the CRPF as armed forces in a decision given on 11 February 1981 (Akhilesh Prasad vs Union Territory of Mizoram). Under that decision, CRPF was placed in the category of "Armed Forces of the Union". Therefore, the personnel of the paramilitary forces should also get the status of X-Serviceman.

हालांकि, हाईकोर्ट ने इस पर कोई सीधा आदेश पारित करने से इनकार कर दिया। अदालत ने कहा कि यह मामला नीतिगत है और इसमें हस्तक्षेप करना न्यायालय के अधिकार क्षेत्र में नहीं आता। साथ ही, पंजाब सरकार को निर्देश दिया गया कि वह याचिकाकर्ता के इस प्रतिनिधित्व पर विचार करे और उचित निर्णय ले।

अदालत ने यह भी कहा कि राज्य सरकार छह माह के भीतर इस विषय पर कोई उपयुक्त आदेश पारित कर सकती है। इस तरह, याचिका का निस्तारण करते हुए अदालत ने स्पष्ट कर दिया कि पैरामिलिट्री बलों को पूर्व सैनिक का दर्जा देने का सवाल अदालत के नहीं बल्कि सरकार के पाले में है।

इस फैसले के बाद यह साफ हो गया है कि आने वाले समय में यदि सीआरपीएफ, बीएसएफ, सीआईएसएफ जैसे अर्धसैनिक बलों को पूर्व सैनिक की श्रेणी में शामिल करना है तो इसके लिए राज्य सरकार को नीतिगत फैसला लेना होगा। वहीं, पूर्व सैनिक संगठन लंबे समय से मांग कर रहे हैं कि देश की सुरक्षा में समान भूमिका निभाने वाले पैरामिलिट्री बलों को भी सेना की तरह एक्स-सर्विसमैन का दर्जा मिले।
